Terms & Conditions of Service

  1. The client authorizes FALX Data Recovery and it’s independent contractors to receive and transport the device (sent for data recovery) to or from their facilities by registered post.
  2. The client represents, warrants and affirms that he/she or it is the owner of the device sent for data recovery.
  3. Any property left with FALX Data Recovery for more than 30 days will be disposed of, sold, re-used or recycled unless otherwise agreed upon. FALX Data Recovery shall have No liability to the client or any third party.
  4. The client understands that data recovery cannot be guaranteed. Every effort will be made to make it successful.
  5. We cannot guarantee how much data can be recovered from the client’s device, we will only know when the recovery is complete. On request, you will be provided a detailed report of what data was recovered and in what condition before payment is made. After target data is recovered we will proceed to recover up to 100% of all data on the device.
  6. The client understands that a hard drive, flash drive, memory card or mobile phone may fail at any time even while in the possession of FALX Data Recovery and shall not hold FALX Data Recovery liable for any such failure.
  7. In no event will FALX Data Recovery or a contractor will be liable for any loss of data, damage to the device, loss of revenue or profit, or any other consequence of the service provided.
  8. FALX Data Recovery agrees to keep all data recovered private and confidential at all times. All data will remain confidential in accordance with privacy laws and our privacy policy. If any data recovered is requested by law enforcement, this will be provided in accordance with the law.
  9. Payment is due in full prior to release of data, unless by special previous arrangement.
  10. No-Data, No-Fee policy only applies for certain cases. In some cases an initial fee may be requested before work is started. This is always stated in a quote after the evaluation of your device.
  11. The client is financially responsible for shipping costs to our lab. If data recovery is successful, the final fee includes express, signed for, postage back to the client.
  12. Payment Methods accepted: Cash, EFTPOS, Visa, Mastercard, American Express, bank transfer, Diners and bank cheque.
  13. A $90 cancellation fee must be paid if the client approves a quote for any service (regardless of no-data, no-fee policy on most services) then more than 24 hours later cancels the requested data recovery service without an agreeable explanation. This fee may be waived at the discretion of FALX Data Recovery.
  14. Once the data recovery work is completed and the client confirms target files have been recovered there will be no refund for any reason if any files are damaged, missing or corrupted after data has been delivered.
  15. Payment is required within 14 days of the work being completed. You can pay by Cash, EFTPOS, bank transfer or Credit card. We will need payment in full in cleared funds before we return your data to you.
  16. Once the data recovery work is completed you must pay us in full before the data will be provided to you.
